The groups’ arguments included that Louisiana’s Coastal Resources Management Act and its regulations required consideration of cumulative impacts, including impacts “from the project’s destruction of more than 300 acres of wetlands that would protect St. Bernard Parish from storm surges and flooding” and “from the project’s cumulative emissions and related increases in storm severity and sea level rise.” The groups contended that the failures to comply with the Coastal Resources Management Act and its regulations also constituted failures to meet public trustee obligations under the Louisiana Constitution.
