08/26/2009 Petition for Writ of Mandate Petition for writ of mandate filed. An environmental nonprofit group filed a lawsuit against the California Department of Transportation, alleging that the agency’s environmental impact report, which was required pursuant to the California Environmental Quality Act (CEQA), with respect to a highway widening project was flawed. The lawsuit alleged that while the EIS disclosed that the project would increase GHG emissions on the highway by 27% annually, it did not analyze the significance of that impact on climate change, and it did not consider alternative means of accomplishing the project’s goals in a way that would avoid climate impacts.
