    05/24/2004 Opinion and Order Download Plaintiffs' motion for partial summary judgment granted; defendants' cross-motion for summary judgment denied. A federal district court rejected a challenge to the Federal Highway Administration's approval of one segment of a 16.7-mile highway that alleged that the EIS failed to analyze the project's effect on climate change, holding that plaintiffs did not establish that small increase in vehicle congestion would lead to significant air quality impacts. However, the court held that the EIS was inadequate for other reasons.
