The Duke Environmental Law & Policy Clinic submitted a rulemaking petition to the North Carolina Department of Environmental Quality and the North Carolina Environmental Management Commission (EMC) on behalf of three youth petitioners and present and future generations requesting that the agencies require that carbon dioxide emissions within the boundaries of the state be reduced to zero by 2050. The petition asserted that such action was required to meet the EMC’s public trust obligations “to protect human health, prevent injury to animal and plant life, and ensure that the State’s natural resources will be protected and conserved for future generations.”
