The Center for Biological Diversity sent a 60-day notice of intent to sue to the Secretary of the Interior and the U.S. Fish and Wildlife Service for failing to conduct a five-year status review and complete a recovery plan for the polar bear. The polar bear was listed as a threatened species under the Endangered Species Act (ESA) in 2008 because of declining Arctic sea ice habitat. The notice stated that new evidence showed sea ice habitat was declining more rapidly than predicted and that the polar bear’s status now warranted an endangered listing under the ESA.
