    08/27/2009 Memorandum Download Affirmation of district court's decision that North Slope failed to show that MMS acted arbitrarily or capriciously. The Ninth Circuit upheld a federal agency’s decision not to prepare a supplemental environmental impact statement for a proposed oil and gas lease sale on a tract of the outer continental shelf in the Beaufort Sea. The court upheld the lower court’s decision holding that the agency did not act arbitrarily in determining that the risks posed to polar bears by the cumulative effects of climate change could be mitigated.
