The complaint was a facial challenge to the permit and also a challenge to a bulkhead in Savannah, Georgia, authorized under the permit. The plaintiffs brought claims under the Clean Water Act, the Rivers and Harbors Appropriation Act, the National Environmental Policy Act, and the Endangered Species Act.
