    02/25/2020 Opinion Download Dismissal of case affirmed. Washington Appellate Court Said Agency Conducted Adequate Search for Records Related to Greenhouse Gas Analysis for Coal Terminal. The Washington Court of Appeals affirmed dismissal of a Public Records Act lawsuit brought by the developer of a proposed coal export terminal. The appellate court rejected the developer’s argument that the Washington State Department of Ecology failed to conduct an adequate search in response to the developer’s request for “data and assumptions” used to prepare an analysis of the proposed terminal’s greenhouse gas emissions.
