    02/18/2009 Order Download Order issued denying review in part and remanding in part. The Environmental Appeals Board (EAB) denied review of some aspects of Sierra Club's challenge to a prevention of significant deterioration permit for a new boiler at Northern Michigan University's campus in Marquette. The EAB remanded other issues, including the determination of whether carbon dioxide emissions should be subject to best available control technology limits. The EAB directed that the Michigan Department of Environmental Quality should be guided by the EAB's November 2008 decision in In re Deseret Power Electric Cooperative.
