The Indiana Office of Environmental Adjudication granted a utility company's motion to dismiss a portion of a challenge to an air permit for a coal-fired power plant. The organizations challenging the permit had argued that the Indiana Department of Environmental Management was required to impose best available control technology limits for carbon dioxide and nitrous oxide.
