    01/28/2008 Order Download Review denied. The Environmental Appeals Board (EAB) declined to consider the issue of whether a prevention of significant deterioration permit for a coal-fired power plant in Illinois was required to contain a best available control technology limit for carbon dioxide. The EAB said Sierra Club could not raise the issue for the first time in an administrative appeal because the issue was reasonably ascertainable before the close of the public comment period on the draft permit.
