Four environmental groups and a Texas resident filed a Clean Air Act citizen suit seeking to compel EPA to respond to petitions requesting that EPA object to Title V permits issued by the Texas Commission on Environmental Quality for eight facilities, including facilities that the plaintiffs allege are major sources of greenhouse gases. The plaintiffs filed the petitions between 2017 and 2020. They asserted that the EPA Administrator had a nondiscretionary duty to grant or deny the petitions.
