    02/09/2010 Opinion Download Summary dismissal and denial of motion for reconsideration affirmed. In an unpublished opinion, the Michigan Court of Appeals affirmed the trial court's summary dismissal of the plaintiffs' request for a writ of mandamus requiring the Department of Environmental Quality to promulgate rules regulating carbon dioxide emissions. The appellate court concluded that the plaintiffs failed to establish they had a clear legal right to promulgation of specific emissions.
