    09/08/2008 Settlement Agreement Settlement reached. The Center for Biological Diversity entered into a settlement with the U.S. Fish and Wildlife Service concerning its lawsuit seeking to compel the agency to determine whether 12 penguin species should be listed as endangered under the Endangered Species Act because of climate change. The lawsuit was filed in February 2008 after the agency missed a statutory deadline to determine if listing the species was warranted. Under the terms of the settlement, the agency has until December 19, 2008 to make such a determination.
