    09/02/2022 Complaint Download Complaint filed. Plaintiffs Said BLM Should Have Considered Climate Concerns Before 2022 Gather of Wild Horses and Burros. A lawsuit filed in the federal district court for the District of Nevada challenged the U.S. Bureau of Land Management (BLM) decision to remove wild horses and burros from Herd Management Areas in August 2022. The plaintiffs alleged that BLM violated the Wild Free-Roaming Horses and Burros Act, NEPA, the Administrative Procedure Act, and the First Amendment. The plaintiffs’ allegations included that BLM gathered the horses and burros pursuant to a 2017 approval of a 20-year gather plan without incorporating new priorities such as climate concerns.
