11/20/2013 Stipulation Joint stipulation filed to dismiss case voluntarily.
11/26/2012 Petition for Review Petition for review filed. Two industry associations filed lawsuits against EPA challenging the agency’s 2013 volume requirements for biomass-based diesel fuel. The final rule mandated the use of 1.28 billion gallons of biodiesel in 2013, a 28% increase from the 2012 requirement. According to the lawsuits, the costs for producing the fuel greatly outweigh the benefits and fraudulent biofuel credits undermine the program.
