09/27/2013 Federal Register Notice Settlement announced. EPA announced a proposed settlement agreement pursuant to which the case would be dismissed in exchange for adoption of amendments to the reporting rule.
11/16/2012 Petition for Review Petition for review filed. An industry group filed a lawsuit alleging that the emissions factors developed by EPA as part of its greenhouse gas reporting requirements for paper mills and biomass-fired boilers exceed actual measured emissions and should be revised. According to the lawsuit, emissions factors the agency required paper mills and boilers to use when calculating their methane and nitrous oxide emissions greatly overstated actual emissions. EPA’s greenhouse gas reporting rule required facilities such as power plants, petroleum refineries, and manufacturing plants with emissions greater than 25,000 tons per year to submit annual reports.
