The Center for Biological Diversity (CBD) sent a 60-day notice of its intent to file a lawsuit challenging the decision of the U.S. Fish and Wildlife Service (FWS) to list the Gunnison sage-grouse as a threatened—rather than endangered—species under the Endangered Species Act (ESA). The notice, which CBD sent on behalf of itself and the Western Watersheds Project, said the FWS’s decision was based on political pressure and that it violated both the substantive and procedural requirements of the ESA. Among other things, the notice said that the FWS “arbitrarily decided” that climate change was not a real threat to the species.
