Oral Argument Scheduled for September in Challenges to Vehicle Greenhouse Gas Emission Standards. On September 14, 2023, the D.C. Circuit Court of Appeals will hear oral argument in challenges to EPA’s greenhouse gas emissions standards for light-duty vehicles for 2023 and later model years and the National Highway Traffic Safety Administration’s (NHTSA’s) fuel economy standards for model years 2024-2026. The oral argument regarding the EPA standards will focus on whether petitioners’ arguments are properly before the court, whether EPA’s rule is authorized under Section 202 of the Clean Air Act, and whether EPA’s rule is arbitrary and capricious. The oral argument regarding the fuel economy standards will focus on Energy Policy and Conservation Act preemption issues and arguments that NHTSA improperly considered factors such as the fuel economy of electric vehicles and plug-in hybrid vehicles. A portion of the argument will also address issues regarding NHTSA’s treatment of high-compression-ratio Atkinson-enabled engines. 06/23/2023 Order Download Oral argument scheduled for September 14, 2023. 05/05/2023 Reply Download Reply brief filed by petitioner American Fuel & Petrochemical Manufacturers and state petitioners. 05/05/2023 Reply Download Reply brief filed by petitioner Natural Resources Defense Council. 05/05/2023 Reply Download Reply brief filed by intervenors in support of petitioners. 04/11/2023 Brief Download Brief filed by respondent-intervenors National Coalition for Advanced Transportation and Zero Emission Transportation Association. 04/11/2023 Brief Download Brief filed by respondent-intervenor public interest organizations. 04/11/2023 Brief Download Brief filed by state and local government respondent-intervenors. 04/03/2023 Amicus Brief Download Brief filed by amici curiae Senator Tom Carper and Representative Frank Pallone, Jr. in support of respondents. 03/21/2023 Brief Download Brief filed by respondents. 12/08/2022 Brief Download Brief filed by intervenors in support of petitioners. 12/01/2022 Amicus Brief Download Brief filed by Alliance for Automotive Innovation as amicus curiae in support of the state petitioners and petitioner American Fuel & Petrochemical Manufacturers. 12/01/2022 Amicus Brief Download Brief filed by ConservAmerica as amicus curiae in support of petitions and remand to agency. 12/01/2022 Amicus Brief Download Brief filed by amicus curiae The Sulphur Institute in support of petitioner. 12/01/2022 Amicus Brief Download Brief filed by amici curiae Texas Oil & Gas Association et al. in support of certain petitioners. 12/01/2022 Amicus Brief Download Brief filed by amici curiae The Two Hundred for Homeownership and The 60 Plus Association. 12/01/2022 Amicus Brief Download Brief filed by amici curiae Western States Petroleum Association et al. in support of petitioner American Fuel & Petrochemical Manufacturers and state petitioners. 11/29/2022 Amicus Brief Download Brief filed by amici curiae California Business Roundtable and California Manufacturers & Technology Association in support of petitioner American Fuel & Petrochemical Manufacturers and state petitioners. 11/17/2022 Brief Download Brief filed by petitioner Natural Resources Defense Council. 11/17/2022 Brief Download Brief filed by petitioner American Fuel & Petrochemical Manufacturers and state petitioners. 08/12/2022 Order Download Clean Fuels Development Coalition et al.'s motion to intervene granted. 08/03/2022 Order Download National Coalition for Advanced Transportation et al.'s, public interest organizations', and states and municipalities' motions for leave to intervene granted. 08/01/2022 Motion to Intervene Download Motion for leave to intervene filed by public interest petitioners. 08/01/2022 Motion to Intervene Download Motion filed by states and municipalities for leave to intervene in support of respondents. 05/11/2022 Petition for Review Download Petition for review filed.
